Delays and losses due to temporary works failure at Dry Dock project referred to litigation

Vantage Three was instructed to provide expert evidence in litigation between a contractor and its designer in relation to the extent and causes of critical delay arising from a temporary works failure on a dry dock improvement project.

The works related to the design and construction of a new outer sea defence structure at an existing outer dry dock gate location. The new outer sea defence structure allowed the original 100-year-old gate to remain in-situ without the need for extensive functional repairs.

A temporary cofferdam which was constructed to provide a dry working area around the original gate failed.

Vantage Three's Expert determined the actual critical path (applying the As-Planned vs. As-Built Window approach) with reference to the facts and any necessary assumptions.

The opinions reached by Vantage Three's expert were not contested.
